49 CFR 391.51 requires a motor carrier to maintain a qualification file for each driver it employs. A file may be combined with the personnel file, but access, retention, and update controls still matter. This checklist summarizes common file categories; the regulation and any applicable exception control.
Core qualification-file records
- Employment application: a completed and signed application that meets 49 CFR 391.21.
- Initial motor-vehicle records: records received from each required state licensing agency during the investigation required by 49 CFR 391.23.
- Road-test evidence: the road-test certificate, or the licence or certificate accepted as an allowed equivalent under 49 CFR 391.33.
- Annual motor-vehicle record: the record obtained for the annual inquiry required by 49 CFR 391.25.
- Annual review note: evidence that the carrier reviewed the driver’s record as required.
- Medical-status evidence: the record required for the driver’s licence and operation. For many CDL drivers, this is based on the state-issued CDLIS motor-vehicle record rather than retaining a paper medical certificate.
- Variance or exemption: any applicable Skill Performance Evaluation certificate, medical variance, or federal exemption documentation.
Investigation and hiring records to track
- Document the required previous-employer safety-performance investigations and the driver’s written authorization.
- Track the request date, response, follow-up attempts, and any allowed documentation when an employer does not respond.
- Separate drug and alcohol testing records when the confidentiality and retention rules require restricted storage.
- Verify licence class, endorsements, restrictions, medical status, and disqualification information before assigning covered driving.
Annual update workflow
- Run a report identifying files due for an annual motor-vehicle-record inquiry and review.
- Obtain the record from the correct state source.
- Review violations, suspensions, restrictions, medical status, and qualification concerns.
- Document the reviewer, review date, decision, and follow-up.
- Calendar the next due date and any earlier licence, medical-status, or variance expiration.
Retention notes
FMCSA states that the qualification file generally must be retained while the driver is employed and for three years afterward. Some items may be removed three years after execution or issue under 49 CFR 391.51(d). Other driver, testing, hours-of-service, accident, or personnel records can have different retention rules; do not apply one retention period to every record.
Electronic file controls
- Use a unique driver identifier and a consistent folder index.
- Restrict access by job role and keep an access log where appropriate.
- Store readable records with source and effective dates.
- Protect backups and test restoration.
- Do not place regulated records in a public form, email thread, or open chat without an approved secure process.
Common review findings
- Missing employment application fields or signatures.
- Incomplete previous-employer investigation attempts.
- Annual MVR or review completed late.
- Expired licence, incorrect endorsement, missing variance, or unresolved restriction.
- Medical-status evidence handled under an outdated paper-only process.
- Owner-operators who drive omitted from the carrier’s file system.
